SWARAJ ABHIYAN DEPLORES SOFT APPROACH ON HINDU TERRORISM ACCUSED IN MALEGAON BOMB BLAST
The recent disclosure by Special Public Prosecutor Rohini Salian in the Malegaon bomb blasts case, involving Hindutva terror, raises several disturbing questions. She has effectively blown the lid off a diabolical plan to pervert the cause of justice. As it is, it took an upright and courageous officer like ATS chief Hemant Karkare, martyred during the 26/11 attack on Mumbai, to uncover this conspiracy. It needs to be recalled that Hemant Karkare was roundly attacked and condemned by Mr. Advani, Mr. Modi and others leaders of the Sangh parivaar for this courageous and patriotic act. It took a determined Prosecutor like Ms. Salian, renowned for securing conviction for many of the Dawood gang associates, to bring the Malegaon case to this point. Clearly, her indefatigable work has upset powers that be.
The NIA, the agency in charge of prosecution, is directly under the control of the central government, with former BJP President Mr. Rajnath Singh as the minister in-charge. It is deeply disturbing to read about the instructions to Ms Salian to “go slow” in the case involving Sadhvi Pragya, Col. Purohit, Swami Asseemanand (whose ashram in Dangs was patronised by, among others, the state’s then Chief Minister Mr. Narendra Modi) and a host of others. It is also shocking to read that the ongoing investigation itself has been stalled, particularly as names of some RSS bigwigs like Mr. Indresh Kumar had featured in judicial confessions as well as in the investigation reports. The NIA’s claim, that Ms. Salian was under-performing, given her track record and the progress of the case so far. It seems that she was over-performing and the government was worried.
This seems to a part of a larger pattern of partisan application of rule of law. In the last few months, almost all the Gujarat police officers accused of cold-blooded murders in the name of “encounters” have been granted bail. Some have even returned to active duty. Convicted criminals like ex-Minister Ms. Maya Kodnani and Mr. Babu Bajrangi are out on parole, instead of serving the long and harsh prison terms awarded to them in lieu of a death sentence. The CBI’s refusal to appeal against the strange exoneration of Mr Amit Shah, the BJP president has also raised serious questions.The Malegaon trial seems to be headed in a similar direction.
Swaraj Abhiyan deplores the double standards being used by the government to deal with two different sets of terrorism accused depending on their religion. Mr Prashant Bhushan, co-founder of Swaraj Abhiyan, tweeted that this case shows that the “NDA government protects Hindu terrorists”. Such an approach would bring disrepute, both within and outside India, to the country’s battle against terrorism. We demand a full and credible probe into the role of the Minister, his deputy, other party leaders, bureaucrats under orders from their political masters and other Hindutva leaders from fraternal organisations in this attempt to thwart justice. Swaraj Abhiyan will continue to monitor the progress of this case and inform the public about further attempts to secure the release of Hindu terror accused. This should ring alarm bells about other cases such as Samjhauta Express and Mecca Masjid etc. where other Hindu terrorists are involved. All these cases now need to be watched by civil society and monitored by the Supreme court.
